Upon recommendation of the Superintendent, the Board of Education approve the following:

  1. Special Education program service recommendations from the Committee on Special Education.
  2. Adopt the 2021-2022 Schenevus Central School District Budget at $______________, with the tax increase of ______________%.
  3. BOARD RESOLUTION

WHEREAS, The Board of Education adopted a resolution dated _____________, 2018, authorizing the commencement of litigation against the NY44 Health Benefits Plan Trust (“the Trust”) and any other parties necessary to such litigation; and

WHEREAS, A Complaint was filed in New York State Supreme Court, Erie County, on April 12, 2018 under Index Number 805785/2018 naming the Schenevus Central School District/BOCES as a Plaintiff and the Trust, its individual trustees and Erie 1 BOCES as Defendants; and

WHEREAS, By motion dated December 18, 2020, the Trust and individual trustees moved for summary judgment dismissing the First, Third and Eight Causes of Action set forth in the Complaint filed under Index Number 805785/2018; and

WHEREAS, Plaintiffs also moved on December 18, 2020, for partial summary judgment on the First Cause of Action in the Complaint, and opposed the Trust’s motion; and

WHEREAS, after oral argument held on February 26, 2021, the court denied Plaintiffs’ motion for partial summary judgment, granted the Trust’s motion for summary judgment and dismissed the Complaint;

WHEREAS, counsel to the District has recommended that Plaintiffs file a Notice of Appeal from each and every part of the Court’s February 26, 2021 decision and subsequent Order, in order to preserve the right to pursue an appeal of the Court’s decision and order, and; 

NOW, THEREFORE, BE IT RESOLVED that the Board of Education authorizes Costello, Cooney & Fearon, PLLC, as counsel to the Board and District in the above-referenced proceeding under Index Number 805785/2018, to file a Notice of Appeal of each and every part of the Court’s February 26, 2021 decision.

  1. RESOLVED, the Board acknowledges the gift of $540.00 from an anonymous donor for the Donor’s express purpose of publishing on the District’s website a property tax calculator for public use. The Board extends its thanks to the donor.
  2. Approve the Bonadio Group for an audit engagement prior to the end of 2021 school year. (Need Signature) 
  3. RESOLUTION OF BOARD OF EDUCATION

FOOD and CAFETERIA SUPPLIES

SCHOOL YEAR 2021-2022

WHEREAS, It is a plan of a number of public school districts in the Delaware-Chenango-Madison-Otsego BOCES Area in New York, to bid jointly Cafeteria supplies including but not limited to food and paper items, and

WHEREAS, The Central School named below is desirous of participating with other districts in the Delaware-Chenango-Madison-Otsego BOCES Area in the joint bidding of the commodities mentioned above as authorized by General Municipal Law, Section 119-o, and

WHEREAS, The Central School named below wishes to appoint a committee made up of participating schools to assume the responsibility for drafting of specifications, advertising for bids, accepting and opening bids, tabulating bids and awarding bids and reporting the results to the schools; therefore;

BE IT RESOLVED, That the Board of Education of the Central School listed below hereby appoints the Delaware-Chenango-Madison-Otsego BOCES to represent it in all matters relating above, and designates the Evening Sun Newspaper as the legal publication for all Cooperative Purchasing bid notifications, and,

BE IT FURTHER RESOLVED, That the Board of Education of the Central School listed below authorizes the above committee to represent it in all matters leading up to the entering into a contract for the purchase of the above mentioned commodities, and,

BE IT FURTHER RESOLVED, That the Board of Education of the Central School listed below agrees to (1) assume its equitable share of the costs of the Cooperative Bidding; (2) abide by majority decisions of the participating districts on quality standards; (3) that it will award contracts according to the recommendations of the committee; (4) and that after the award of the bid it will conduct all negotiations directly with the successful bidder(s).

WHEREAS, It is a plan of a number of public school districts in the Delaware-Chenango-Madison-Otsego BOCES Area in New York, to bid jointly equipment, supplies and  contract items, and

WHEREAS, The Central School named below is desirous of participating with other districts in the Delaware-Chenango-Madison-Otsego BOCES Area in the joint bidding of the items mentioned above as authorized by General Municipal Law, Section 119-o, and

WHEREAS, The Central School named below wishes to appoint  a committee made up of participating schools to assume the responsibility for drafting of specifications, advertising for bids, accepting and opening bids, tabulating bids and providing the information to their Boardof Education who will make the awards; therefore

BE IT RESOLVED, That the Board of Education of the Central School listed below hereby appoints the Delaware-Chenango-Madison-Otsego BOCES to represent it in all matters relating above, and designates the Evening Sun Newspaper as the legal publication for all Cooperative Purchasing bid notifications and,

BE IT FURTHER RESOLVED, That the Board of Education of the Central School listed below authorizes the above committee to represent it in all matters leading up to the entering into a contract for thepurchase of the above mentioned items, and,

BE IT FURTHER RESOLVED, That the Board of Education of the Central School listed below agrees to (1) abide bymajority decisions of the participating districts on quality standards; (2) that it will awardcontracts based on information provided from the bid; (3) and that after the awardof the bid it will conduct all negotiations directly with the successful bidder(s).

WHEREAS, The Cooperative Purchasing Service is a plan of a number of public school districts in the Delaware-Chenango-Madison-Otsego BOCES Area in New York, to bid jointly equipment, supplies and contract items, and

WHEREAS, The Central School named below is desirous of participating with other districts in the Delaware-Chenango-Madison-Otsego BOCES in the joint bidding of the items mentioned above as authorized by General Municipal Law, Section 119-o, and

WHEREAS, The Central School named below wishes to appoint the Delaware-Chenango-Madison- Otsego BOCES to advertise for bid, accept, tabulate bids and award bids on their behalf; therefore

BE IT RESOLVED, That the Board of Education of the Central School listed below hereby appoints the Delaware-Chenango-Madison-Otsego BOCES to represent it in all matters relating above, and designates the Evening Sun Newspaper as the legal publication for all Cooperative Purchasing bid notifications, and,

BE IT FURTHER RESOLVED, That the Board of Education of the Central School listed below authorizes the Delaware-Chenango-Madison-Otsego BOCES to represent it in all matters leading up to the entering into a contract for the purchase of the above mentioned commodities, and,

Personnel Items: (Motion)

Upon recommendation of the Superintendent, the Board of Education approve the following:

  1. Appoint Jennifer Andrews to the 4 year probationary position of Elementary Teacher effective 9/1/2021 at the contractual rate of Masters Step 2 Probationary period ending 6/30/2025.
  2. Appoint James Gaske to the position of Modified Baseball Coach for the 20-21 school year at the contractual rate.
  3. Appoint Eric Jones to the position of Volunteer assistant for Varsity Baseball during the 20-21 school year. 
  4. Appoint Jessica Barrett to the position of Modified Softball Coach for the 20-21 school year at the contractual rate. 
  5. Appoint the following to the position of Chaperone for the 20-21 school year effective March 26, 2021, at the contractual rate.
    1. Matthew Gregory
    2. Abby Antalek
    3. Jessica Barrett
  6. Appoint Paula Darling to the position of Substitute Teacher at the Non-Certified rate and Substitute Teacher Aide position at the contracted rate starting on 3/15/2021. 
  7. Approve Tim Smith to the position of Volunteer assistant to the Varsity Girls soccer team for the 20-21 school year effective 3/24/2021
  8. Approve Erica Ylitalo to the position of Videographer for the 20-21 school year for livestreaming home sporting events from March-June @ at the contractual rate.
  9. Approve Jessica Trask to the position of Food Service Worker – Hourly at the contractual rate starting on April 22, 2021

  1. Approve the second reading of policy 0101 – Gender Neutral Single-Occupancy Bathrooms.
